Please ensure you take note of the comments Peter Lansdown has made and also the closing date of Wednesday 19th May for any comments we would like to make. Due to the very short response time nominated I suggest that any comments that the committee members want to make regarding the document should be emailed to Anthony Johnstone by Tuesday 18th May so we can incorporate a Nulca Response by the due date.

Following substantial input from many of you, we have now received the attached Consultation Draft for the proposed Electricity Supply (General) Amendment (Infrastructure Protection) Regulation 2010. Although this deals with the proposed amendments to the Electricity regulation, it is proposed that the same principles will be adopted in the amendment to the Gas regulation.
The Minister for Energy has approved our circulation of this to enable the consultation process to be completed.
One area of concern that has been expressed is that which relates to the “exclusions” in clause 104B (2). In our attempts to avoid the need for persons to make a DBYD enquiry for relatively “trivial” excavations, while attempting to ensure that any situation that may result in an underground power line or gas pipeline being damaged, have we inadvertently captured situations where an enquiry is inappropriate? An example given has been kids digging a hole in the sand at the beach.
It would be appreciated that, in addition to your reviewing the draft as submitted, you could also put your minds to this issue and make some suggestions as how we might further improve that area of the draft regulation.
We are anxious to have this regulation finalised and to bring the legislation into force as soon as possible.
We are therefore asking that we receive your comments by close-of-business on Wednesday 19 May 2010.
